- Are there any deed restrictions on the property that was purchased for the data center? This is very important information. If there is a deed restriction the building of the centers could be easily disputed.
- How much was collected in rollback taxes on the property? How will those funds be used? Please confirm that all parcels receiving an agricultural (Ag) exemption were properly assessed and that all applicable rollback taxes were collected.
- What was the water pressure (PSI) for residential properties sharing the same water system before the data center began operations? What is the current PSI now that the data center is operational? Has the city or county conducted any testing to determine whether residential water pressure has been affected?
- Some construction sites appear to be using fire hydrants for dust control. Can the public review the amount of water used, the associated water bills, and confirmation that the developer is paying for all water consumed?
- Were any non-disclosure agreements (NDAs) signed in connection with this project? If so, were they related to security concerns? How are the city and county balancing those agreements with their responsibility to keep residents informed about issues that affect the community?
- What cybersecurity measures are in place to protect residents’ personal information? If a data breach were to occur, who would be responsible for investigating it, notifying affected individuals, and ensuring corrective actions are taken to prevent future incidents?
- Will residents be provided with a list of contact names, phone numbers, and email addresses for the developer so they can report concerns or emergencies directly? If not, who should taxpayers contact when issues arise?
- Have there been any 911 calls or emergency responses to the data center site? If so, has the developer reimbursed, donated to, or otherwise helped offset the costs of emergency services used by the facility?
- Was the developer granted any tax abatements or other financial incentives? If so, what is the total dollar amount of those incentives, what are the terms, and what public benefits are expected in return?
- Did any government official receive benefit from the location of data centers to Bastrop County? For example: Does any government official reside on a board which would control aspects of a data center? Did any government center benefit from land sale, etc., to a data center corporation?
